REFERENCE TERMS:
CONSULTATION CONTRACTOR/TO SUPPORT THE MINISTRY OF ENERGY AND MINES IN THE ELABORATION OF THE PUBLIC POLICY AGAINST THE THEFT OF HYDROCARBURES FOR THE DRAFT CAPACITIES OF THE ECUATORY JUDICIAL SECTOR TO COMBAT THE TRANSNATIONAL CRIMINAL AND NARCOTRAPHIC-CTOC PROJECT

one.BACKGROUND

The Pan American Foundation for Development in Ecuador (PADF, for its acronym in English) within the framework of the DRAFT CAPACITIES OF THE ECUADORIAN JUDICIAL SECTOR TO COMBAT THE TRANSNATIONAL CRIMINATION AND THE NARCOTRAFIC seeks the hiring of a natural person to advise to the Ministry of Energy and Mines in the elaboration of the public policy / ministerial agreement against the theft of hydrocarbons, based on the situational analysis of this phenomenon in recent years.

2. OBJECTIVE OF THE CONTRACTING

Offer technical advice to the Ministry of Energy and Mines in the process of design and construction of public policy for the prevention, control, detection and prosecution of fuel theft.

3. RESPONSIBILITIES OF THE CONSULTOR

Support the Ministry of Energy and Mines in the coordination and development of work tables, survey and systematization of information with relevant areas, mapping of actors and preparation of a base document on public policy in the fight against the theft of hydrocarbons.

4. REQUIRED PROFILE

  • Political scientist or professional in political science, or legal professional with a postgraduate degree in public policy, with more than 5 years of certified policy-making experience.
  • Desirable experience in advising public sector entities.
  • Desirable knowledge of the justice sector and / or hydrocarbon sector.

5. CONTRACTING DEAD

The contract will have a maximum duration of 45 days.

6. PAYMENT BUDGET AND WAY

The total amount of the contract is $ 6000 (includes statutory taxes), which will be canceled as follows:

  • Deliverable 1
    • Deliverable Detail: Work plan that must contain:
      • Work plan
      • Work schedule
    • Delivery date: 7 days from the signing of the contract
    • Value: $ 1800 (30%)
  • Deliverable 2
    • Detail of the deliverable: Situational diagnostic document and first draft of public policy
    • Delivery date: 30 days from the signing of the contract
    • Value: $ 2400 (40%)
  • Deliverable 3
    • Deliverable Detail: Second draft of public policy incorporating the observations mentioned by the CTOC project. The deliverable must contain:
      • Diagnosis of the problem
      • Competences of institutions
      • Inter-institutional articulation
      • Public policy proposal on hydrocarbon theft
    • Delivery date: 45 days from the signing of the contract
    • Value: $ 1800 (30%)

Subtotal: $ 5280

12% VAT: $ 720

Total value: $ 6000

Payment will be made upon presentation of the deliverable and the respective invoice, to the satisfaction of PADF.

7. TERM FOR THE RECEPTION OF PROPOSALS

8. INTELLECTUAL PROPERTY

The professional is prohibited from any type of publication, disclosure or commercialization of the products subject to this contract, as it will be understood that it will become the property of PADF, in the same way, the disclosure of confidential information that comes to your attention as part of the execution of your activities is prohibited.

9. ABOUT PADF

10. TERMS AND CONDITIONS

Outcome of Agreement
These TdRs do not oblige PADF to execute a contract, nor does it commit PADF to pay any cost incurred in preparing or presenting the proposals. Furthermore, PADF reserves the right to reject any and all offers, if such action is considered in the best interest of PADF. PADF, in its sole discretion, will select the winning proposal and is not required to share the results of the individual evaluation.

Confidentiality
All property information provided by the applicant will be treated as confidential and will not be shared with potential or actual applicants during the bidding process. This includes, but is not limited to, price quotes, cost proposals, and technical proposals. PADF may, but is not required to, publish the agreements on its public website after the bidding process has concluded, and the contract has been agreed. The results of the PADF evaluation are confidential and the applicants’ score will not be shared among them.

Protection of personal data
The data derived from the execution of the contract object of this reference term will be used exclusively for its execution and taking into account the provisions of the “ LEY regulations PERSONAL DATA PROTECTION ORGANIC ”, ratified on May 21, 2021.
