Background

The United Nations entity for Gender Equality and the Empowerment of Women, UN Women, based on the vision of equality enshrined in the Charter of the United Nations, works to eliminate discrimination against women and girls; for the empowerment of women, and to achieve equality between women and men as partners and beneficiaries of development, for human rights, in humanitarian actions, in peace and security. By placing women’s rights as the central axis of their work, UN Women leads and coordinates the efforts of the United Nations System to ensure that gender equality and mainstreaming commitments are translated into actions around the world. At the same time,exercises substantive and coherent leadership to support the priorities and efforts of Member States, building an effective partnership with the government, civil society, as well as with other relevant actors.

The six priority areas are:

  •  Expand women’s voices, leadership, and participation;
  •  Eliminate violence against women and girls;
  •  Strengthen the implementation of the women’s peace and security agenda;
  •  Increase the economic autonomy of women;
  •  Make gender equality priorities essential in national, local and sectoral plans, budgets and statistics;
  •  Implement global norms, policies and parameters on gender equality and the empowerment of women, laying the groundwork for action by governments and other stakeholders at all levels.

Two international agreements form the basis of the work of UN WOMEN: the Beijing Platform for Action, resulting from the Fourth World Conference on Women held in 1995, and the Convention on the Elimination of All Forms of Discrimination against Women, considered as the Fundamental Declaration of Women’s Rights. The spirit of these agreements was reaffirmed in the Millennium Declaration and in the eight Millennium Development Goals established for 2015 and later in the 17 Sustainable Development Goals. Security Council resolutions, 1325 (2000) on women, peace and security, and 1820 (2008) on sexual violence in conflict,They are also key benchmarks for UN WOMEN’s work in supporting women in conflict and post-conflict situations.

Background

The UN Women Strategic Plan 2022-2025 seeks to achieve gender equality, the empowerment of all women and girls and the full realization of their human rights. The Strategic Plan is based on the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW), the Beijing Declaration and Platform for Action, Resolution 1325 of the United Nations Security Council on women, peace and security and the subsequent Resolutions of this agenda, the Program of Action of the International Conference on Population and Development and other outcomes of relevant intergovernmental processes, as resolutions of the General Assembly and agreed conclusions of the Commission on the Status of Women.UN Women contributes to the implementation of the Regional Gender Agenda for Latin America and the Caribbean and to the 2030 Agenda for Sustainable Development by placing the Sustainable Development Goal (SDG) 5 gender equality at the center of the SDGs and in coordination with all other Objectives in order to ensure comprehensive progress.

Nine other resolutions on Women, Peace and Security have subsequently been adopted by the Security Council, namely resolutions 1820; 1888; 1889; 1960; 2106; 2122; 2242; 2467; 2493. These resolutions complement resolution 1325. Together with the CEDAW Committee’s General Recommendations 30 and 35, they constitute a powerful platform to build effective actions that end impunity around violence against women, particularly sexual violence, and ensure their participation in all aspects related to peacebuilding and the restoration of the rule of law.

In order to support the implementation of the strategic plan, the UN Women Guatemala Office seeks to hire a consultancy in Retainer modality that can provide specialized technical assistance to strengthen the capacities of public institutions, in accordance with their areas of competence, for the identification, definition and analysis of variables that allow the registration of violence against women.

Duties and Responsibilities

Objective

The main objective of this consultancy is to provide specialized legal technical assistance in constitutional and legislative technical matters for the advancement and protection of women’s human rights.

Scope of objectives

The owner is expected to carry out the responsibilities and activities necessary for the delivery of the products described below in order to achieve the objective/s of consulting.

These responsibilities will include:

  •  Carry out the review and analysis of the legislation, current regulations, legal opinions and technical documents in relation to the processes that were required.
  •  Prepare technical documents that develop categories of legal analysis for the advancement and protection of women’s rights in accordance with international human rights standards and national legislation.
  •  Collaborate with technical teams in legal documentation analysis processes and other indicated and / or required documentation.
  •  Accompany and advise spaces for analysis and work that are required within the framework of consulting, including carrying out knowledge transfer processes to public institutions, systematizing their results.
  •  Prepare a report of conclusions, recommendations and lessons learned resulting from the processes in which your participation is required.
  •  Participate and provide technical support in the work meetings that are held for stakeholders related to the scope of the consulting objectives.
  •  Maintain effective coordination with UN Women for the scope of products at the required times, as well as alerting of important risks that may generate deviations in the scope of the objective of this consultancy.
  •  Make available to UN Women the technical documents generated during this consultancy, in PDF version and editable version.

Deliverable

The specifications related to each product requested, the number of days and the terms will be negotiated and agreed with UN Women and the consultant, case by case.

Before the start of each job, the consultant must confirm their availability in written acceptance to carry out the tasks assigned by each request and / or order, confirming the number of business days required to complete the products requested. The consultant will commit to do what is necessary to be available to carry out the assigned tasks.

Payment method

For each payment the consultant must deliver:

  •  The corresponding invoice duly authorized by the Superintendency of Tax Administration -SAT-. The payment of taxes will be made through a proof of exemption issued by the SAT online system, for the amount of the tax charged on the invoice. The consultant is responsible for paying taxes before the SAT.

The hiring modality “ Retainer ” implies that the consultant will be hired for service with a daily rate determined in his contract.

Economic commitments will be established each time the service is requested under the framework contract based on the fixed daily rate, by managing an approved and agreed purchase order between the parties specifying the scope, products and expected results, as an indication of the start of service provision.

A cumulative maximum will be established that will remain the upper limit and should not be interpreted or understood as a financial commitment or a guarantee of business volumes. For each payment, an invoice must be presented detailing the delivered product and the number of business days.

The SSA contract determines the inclusion of all costs ( all inclusive ); the Organization will not assume additional costs or benefits to service fees. Therefore, it is the responsibility of the consultant to have health insurance for the contract period. Medical coverage must be international in cases where the contract requires international missions or assignments.

If selected for this vacancy, it will be required to present proof of medical coverage within the first two months of the contract.

Performance monitoring and evaluation

The consultancy will be managed by UN Women Guatemala. The supervision of this consultancy will be carried out by the focal point of the Area that requires the service. The Consultant is not a United Nations official and will carry out the activities related to his consultancy in a virtual way, from your own workspace as agreed in the work plan.

Three months after starting the consultancy, an evaluation of the performance of the selected person and the products produced will be carried out, and if it is not favorable, the contract will be terminated by mutual agreement within the following 30 days.

For the proper development of the consultancy, the supervisor will provide the consultant with the existing documents and the information available to UN Women related to the consulting topics. It is the responsibility of the consultant to obtain primary and secondary information from other sources, if necessary.

The consultant will maintain permanent coordination with the supervisor for an effective execution and development of the products requested from this consultancy. As well as, it will provide information as requested within the terms of reference.

Intellectual Rights, Patents and Other Property Rights

The right to equipment and supplies that may be provided by UN Women to the consultant/a for the performance of any obligation under this contract, she must remain with UN Women and said equipment must be returned to UN Women at the end of this contract or when it is no longer necessary for the consultant. Said equipment, when returning it to UN Women, must be in the same conditions as when it was delivered to the consultant, subject to normal deterioration. The consultant will be responsible for compensating UN Women for damaged or damaged equipment regardless of its normal deterioration.

UN Women will have the right to all intellectual property and other property rights including but not limited to: patents, copyrights and trademarks, in relation to products, processes, inventions, ideas, technical knowledge, documents and other materials that the consultant has prepared or collected accordingly or during the execution of this consultancy, and the consultant/a recognizes and agrees that such products, documents and other materials constitute work carried out under the recruitment of UN Women.
