Context L’OIM has been present in Haiti since 1994 and implements a wide range of’activities, among others assistances d’urgences and protection to repatriated migrants, in coordination with local and governmental authorities. IOM supports the Haitian government in the development and implementation of migration policies that align with the country’s overall development goals. These include improving border management, combating irregular migration and promoting safe and orderly migration routes. IOM also provides technical assistance and capacity-building to Haitian institutions, helping them improve their capacity to effectively manage migration issues.

Objectives: Under the supervision of the Project Coordinator the consultant / the consultant will be responsible for the design and development of management protocols – between different governmental and non-governmental, national and international stakeholders, depending on their mandates – of all aspects of return migration to Haiti (in particular repatriations) by Page 2 of 6 air, sea and land routes, in order to ensure that the return migrants are repatriated in a dignified manner. L’the overall objective of this contract is to strengthen the capacity of national and local authorities to better manage return migration (particularly repatriation) by putting in place strategies and strategies procedures to address and address immediate and long-term challenges related to the return movements of forces.

Responsibilities :

Deliverables to be made under the Consultancy contract :

Deliverable 1 : Procedures for the reception and support of repatriated migrants in Haiti

• IDENTIFIER, and take stock of the main state actors involved in the issue of forced returns that play a key role in the management of migrants in repatriation (maritime, international, land or air), reception and support. Accompany, where appropriate, recommendations in terms of capacity building to better carry out their work. These include: the Ministry of Social Affairs through the’National Office of Migration (ONM), the Ministry of Interior’, and, local authorities and National Defence (MICT), notably through its leadership of’Immigration and’Emigration (DIE), the Ministry of Foreign Affairs (MAE), and, from the Ministry of Living Haitians to the FOREIGN’ for its connection with the Haitian diaspora,the Ministry of Justice and Public Security (MJSP), the Ministry of Public Health and Population (MSPP), the National Police of’Haiti (PNH) ; from the Ministry of External Cooperation (MCE), the’Institut of Social Well-being and Research (IBESR) and others.

• Evaluate the current arrangements for managing reception and support for migrants and shortcomings, taking into account existing standard operating procedures ;

• Identify and propose the best practices for the’accueil of migrants according to their age, vulnerability, alone or accompanied, loss of identification documents, repatriated with’ other nationalities, etc, and define the roles and responsibilities of each actor for the implementation of these practices.

• 2 Grouping the practices of’accueil in the form of’a procedure guide that will have to be approved by all stakeholders.

Deliverable 2: Protocol for the repatriation of migrants to Haiti

• Identify, and make an inventory of the Haitian consulates in the countries deporting migrants. Accompany, where appropriate, recommendations in terms of capacity building to better carry out their work.

• Actualize/Redigate the protocols of agreement between the main countries with strong return migration force and the Haitian government (United States, Dominican Republic, Bahamas, Turks and Caicos Islands, etc.). For countries with which there is no protocol, or the protocol of which is obsolete, prepare a proposal for a protocol based on international best practices and lessons learned from other contexts, and, which will be used to integrate feedback and guide discussions for approval and adoption. The protocols will include workflows and diagrams detailing the responsibilities of each stakeholder at each stage of the return of’a Haitian citizen, days and times of repatriations, conditions of detention, etc, Number of days of detention,respect for human dignity throughout the process, etc.

• Organize workshops and exhaustive consultations with the various governments and the respective Haitian consulates to finalize these protocols by including embassies, relevant Haitian ministries and authorities, civil society, grassroots organizations working in the field of migration etc. both nationally and internationally.

Deliverable 3: Protocol validation

• Facilitate the validation of procedures and protocols during institutional events

• Validate the protocols during an institutional event that will conclude all work to achieve commonly accepted protocols.

• Ensure the dissemination of these protocols with the stakeholders concerned

Payment schedule:

1. First payment, 1 month after signing the contract for 15% of the total amount on receipt and validation by the’OIM of :

an initial report confirming the understanding of the mission, its goals, objectives, suggested research methodology, proposed participants and partners, and tools to be used, and, and presenting a detailed work plan that will guide the research.

– A first draft of the Phase 1 document. This first draft should allow the’OIM to evaluate the’advanced work both in quantitative and qualitative terms, to ensure the good understanding of the deliverable by the/consultant(e). All requested sections (see above, “Phase 1”) should be either started or explained by the/consultant(e) in order to verify the correct understanding of the deliverable.

  1. Second payment, 2 months after signing the contract for 20% of the total amount upon receipt and validation by IOM of the final version of the document relating to Phase 1. IOM reserves the right to request modifications to the document before making payment.
  2. Third payment, 4 months after signing the contract for 15% of the total amount upon receipt and validation by the IOM of a first draft of the document relating to Phase 2. This first draft must enable the IOM to evaluate the progress of the work both in quantitative and qualitative terms, in order to ensure a good understanding of the deliverable by the consultant.
  3. Fourth payment, 6 months after signing the contract for 25% of the total amount: upon receipt and validation by the IOM of the final version of the document relating to Phase 2. The IOM reserves the right to request modifications to the document before making payment.

5. Final payment, 8 months after signing the contract for 25% of the total amount: upon receipt and validation by the IOM of all the documents produced during the consultancy as well as after the holding of the institutional event validation of the protocol.

Education and Experience:

• Minimum of a university degree (BAC +4) from a recognized institution in one of the following fields: relevant (Administrative law, International development, Political science or related disciplines.

• Have at least six (6) years of experience in Migration management

• Experience with analyzing legal frameworks

• Experience in advising government authorities, such as the Ministry of Foreign Affairs, the Ministry of the Interior and Local Authorities.

• Experience in organizing and managing international workshops with government representatives.

• Previous experience with IOM or another intergovernmental organization would be an advantage.

LANGUAGES :

Fluency in French and Creole is required. A working knowledge of English is an advantage.
