Referent lawyer·: administrative and legal framework of the missions At Doctors Without Borders


Medecins Sans Frontieres (MSF), an international humanitarian medical association created in 1971, provides medical assistance to populations whose lives are threatened: mainly in the event of armed conflict, by, but also epidemics, pandemics, natural disasters or exclusion from care.

MSF’s operations are managed by 5 Operational Centre based in Paris, Barcelona, Brussels, Amsterdam and Geneva, united within an international movement (MsF Movement) comprising a total of 24 associations.

The Intersection Legal Department is currently the only intersection department of the MSF Movement; its members are based in the various Operational Centres.

Its mission is to provide legal support and analysis to the MSF Movement and the various operational centres, sections and offices and MSF International.

As part of’a replacement, we are looking for a Referent lawyer·: administrative and legal framework of the missions.

Mission:

Within the Intersection Legal Department of MSF, under the responsibility and supervision of the Deputy Head Legal and administrative framework of missions, your main mission is to provide legal advice and support to operational teams regarding the administrative and legal framework of MSF France field missions and projects, in collaboration with the lawyer already in office.

You ensure the coordination and coherence of the legal framework of the’ all the different areas of’activities of the pole, and participate in the development of legal policies relating to these areas, and, with a view to understanding and managing risk in the areas of the cluster, in particular :

  • Registration of structures and persons, and governance of MSF operational entities, including,
  • Negotiations with national authorities: MOU, Agreements and various exemptions (project member SHIELD: Sustainable and Humanitarian Intervention through Exemption and Legal Derogation),
  • Land contracts and management of commercial relations,
  • Support to the’ supply chain,
  • Monitoring of various tax and administrative obligations, and management of various controls,
  • Financial risk management and insurance coverage.

The position involves close collaboration with the other lawyers of the Intersection Legal Department (whether’s are in France or in other sections), but also the different departments of the MSF-France sections, including, as well as field teams and international working groups.

This position is based in Paris and involves regular field trips and occasional trips within the various MSF sections.

Your main responsibilities :

The’action priorities, the topics of funds to be treated, and, the countries to be monitored in particular and the distribution of work with the other lawyers in charge of the administrative and legal framework of the missions is done on delegation, by, according to the annual evaluation of the operational needs of MSF-France, carried out by the head of the cluster. Within the framework of this delegation, the main activities are :

Participate in the definition of legal policies :

  • Decline the strategy and participate with its hierarchy in the definition of legal policies by bringing knowledge in the fields of its pole, and,
  • Ensure the proper implementation of the strategy, policies and objectives.

Provide advice and support to teams of cells, in the field and to the network of lawyers:

  • Advise and manage issues related to the administrative and legal framework of missions with headquarters and field officials
  • Ensure the application of the legal procedures
  • Manage litigation by providing appropriate solutions
  • Ensure the implementation of’tools in support of the teams of cells and projects: guides, models, guidelines, model agreements, contracts, MOU, etc.
  • Support and advise other lawyers on its perimeter

Participate in legal projects :

  • Participate and be a force of proposal in the implementation of legal projects within the MSF international movement
  • Set up monitoring and reporting tools
  • Supervise the trainees, in charge of’studies or the lawyers involved in the files for which he/she has responsibility

Transferring legal skills :

  • Development and updating of training content related to the administrative and legal framework of missions
  • Animation of training modules for operational teams (cells and field)
  • Implementation, adaptation and dissemination of practical guides, legal notes and fact sheets on all topics related to its activities, including, with the aim of’autonomizing the operational teams (section MSF and MSF International) on the management of legal risks

Realize the legal monitoring on its specialties /priority topics :

Capitalization, management of legal monitoring and drafting of summary note, memo, guides on priority topics under its specific responsibility.

Professional skills

Training :

  • You are a Lawyer /Avocat, holder of a higher education’ (Master 2) in Private Law.

Experience :

  • MSF experience or international humanitarian organisation is required.
  • You have at least 3 years of experience as a Lawyer/Lawyer ideally acquired within an international company or in an international law firm.
  • Experience in Common Law desired.
  • You have a very good command of legal drafting techniques, a first experience in the management of various administrative constraints abroad, as well as’ a good experience of negotiation.

Languages : You have’a very good level of’english and legal French (B2 minimum). Another language would be an asset.

Status : CDI full time, based in Paris, metro Jaures with possibility of 2 days of telework per week. Assimilated post frame, 39h weekly.

Salary conditions : 49,6K€ gross annual over 13 months.

22 Days of RTT per year. Complementary health care 100% supported by Doctors Without Borders. Titles restaurants d’a face value of 11€ (60% support by Doctors Without Borders). Support for 50% of the public transport ticket.
