one.BACKGROUND

The Pan American Development Foundation (PADF) is a non-profit organization created in 1962 through a unique agreement between the Organization of American States (OAS) and the private sector. Its mission is to work in alliance with the governmental, non-governmental and private business sectors for the benefit of the less favored populations.

PADF seeks to prevent human trafficking in migration, strengthen institutional frameworks to protect victims and potential victims on the migration route, and support the protection services available to migrants who have been victims of trafficking in Mexico.

Along these same lines, PADF works supporting the efforts that the Inter-secretarial Commission to prevent, punish and eradicate crimes related to human trafficking and for the protection and assistance to victims of these crimes by the Ministry of the Interior. The Commission, aware of the complexity of the problem, has created specific working groups to implement a national training program on trafficking in persons. PADF actively collaborates with the sub-working group to design the course on Prevention of trafficking in persons in migratory contexts.

2. OBJECTIVES OF THE CONTRACTING

General objective: Pedagogical Development of a Course on Protection of Trafficking in Persons in Migratory Contexts in Mexico

Develop a complete and effective training course that specifically addresses the dynamics, profiles, regulatory framework, among others, of human trafficking in the context of migration in Mexico. Some of the topics to be addressed are: Definitions and concepts; Awareness of: people in situations in vulnerable / at risk conditions; Stigmatization, discrimination of migrants; Route to follow, detection/identification and reference; Processes regarding how public servants should conduct themselves (non-revictimizing action and acting under the principle of action without harm); Awareness of the profile of people who are in a migration situation; Instruments or information for servers that are caring for victims of trafficking; Risks, experiences, routes,more frequent situations; More recurring characteristics of victims who are cared for according to their characteristics, addressing various profiles, realities, human rights violations; Case studies; Information on migratory flows within Mexico, origin, transit and destination.

Activities:

  • Research and analysis of current trends, challenges, risks, profiles of human trafficking in migratory contexts in Mexico, as well as review of both the national and international regulatory framework.
  • Development of a training program that includes modules, activities, exercises and evaluations. The modules to be developed must include as a minimum: Human Trafficking and Migration: conceptual content, international legal frameworks, applicable national legislation for each topic, the federal and state institutions existing in each problem, as well as Trafficking in Persons in Migration: Challenges in Mexico and for public servants must address this issue.
  • Creation of educational materials in various formats, such as presentations, instructor guides, and manuals.
  • Adaptation of the contents already developed by PADF and other organizations to satisfy the specific needs of the target audience in Mexico, considering cultural and linguistic diversity. For the development of the training program, consider taking the EC1425 Competition Standard as a general frame of reference. Detection of possible victims of human trafficking during immigration proceedings within the framework of protection of human rights
  • Attendance at planning sessions with PADF to ensure effective course development.

3. EXPECTED PRODUCTS

  4. Product: Final course
    1. Description: The completed course (development of agreed topics and adaptation of existing material)
    2. % of the total consulting amount: 30% (100%)
    3. Estimated delivery time: 60 days after signing the contract

4. CONFIDENTIALITY, INTELLECTUAL AND PROPERTY RIGHTS

All titles, copyrights, patents or other property rights of any work directly required in or resulting from this consultancy rest with PADF. At the request of PADF, the consulting person will help secure the intellectual property rights produced under these TDRs and the signed contract.

The consulting product may not be used without written authorization. Any type of reproduction, publication, dissertation or public disclosure or with third parties is prohibited, by any verbal, audiovisual and / or written method of the material of the provision of its services. If published, the respective credits will be mentioned. The contracted professional / company undertakes to maintain confidentiality regarding the process and the results of the consultancy.

5. FORMAT AND CONTENTS OF THE PROPOSALS

Proposals must include the following elements:

  • Technical proposal
  • Economic proposal
  • Background and experience of the applicant, as well as the work team

6. EVALUATION CRITERIA OF PROPOSALS

The proposals received for the performance of the requested services will be evaluated according to the following criteria and scores:

Technical and Economic Criterion

  • Technical proposal (35 points)
  • Economic proposal (30 points)
  • Background and experience of the applicant and his team (35 points)

Maximum score – 100 points

7. PAYMENT FORM

The form of payment will be made in accordance with what is agreed in the consulting contract proportionally. Payments will be made by international bank transfer, from PADF headquarters in Washington, DC, when delivering each product established in the terms of reference, and once validated by the technical or responsible area.

10. TERMS AND CONDITIONS

Outcome of Agreement

This SdP does not oblige PADF to execute a contract, nor does it commit PADF to pay any cost incurred in preparing or presenting the proposals. Furthermore, PADF reserves the right to reject any and all offers, if such action is considered in the best interest of PADF. PADF, in its sole discretion, will select the winning proposal and is not required to share the results of the individual evaluation.

Confidentiality

All property information provided by the applicant will be treated as confidential and will not be shared with potential or actual applicants during the bidding process. This includes, but is not limited to, price quotes, cost proposals, and technical proposals. PADF may, but is not required to, publish the agreements on its public website after the bidding process has concluded, and the contract has been agreed. The results of the PADF evaluation are confidential and the applicants’ score will not be shared among them.

Protection against Sexual Exploitation and Abuse (PEAS)

As part of the contractor’s internal controls and employee standards of conduct, the contractor must ensure that its employees adhere to these standards of conduct consistent with the standards for United Nations (UN) employees in Section 3 of the Bulletin of the UN Secretary General – Special measures to protect against sexual exploitation and abuse (ST / SGB / 2003/13).

Recruitment of Small, Minority and Women’s Companies

PADF will take all necessary steps to ensure that minority businesses, women’s businesses, and area companies with surplus labor are used when possible.

Disabling and suspension

Entities appearing on any exclusion list, the Agreement Management System ( SAM ), the Office of Foreign Assets Control ( OFAC ), the United Nations Sanctions List and other watch lists, they will not have their offer evaluated and will not be eligible to receive any sub-agreements that may result from this Request for Proposals.
