Recruitment of a consultant for the preparation of modules and delivery of training on the national and international legal framework for the fight against human trafficking in Djibouti for students of the National School of Judicial Studies

I- Context and Justification

Located on the Babeb – Mandeb Strait at the southern entrance to the Red Sea and serving as a gateway to the Suez Canal, the Republic of Djibouti is a transit and destination hub for many irregular migrants from neighboring countries. , notably the Federal Republic of Ethiopia, and head towards the Gulf countries.
According to data from IOM Djibouti, 278,272 migratory movements were observed in 2023 at the various flow monitoring points, an increase of 25% compared to 2022. The crossings are often perilous and are the cause of Tragic incidents often leading to the death of migrants. Irregular migrations to Djibouti then Yemen and Saudi Arabia are fundamentally motivated by the search for better living conditions and economic opportunities to counter poverty and socio-economic marginalization in families and communities of origin.
The Republic of Djibouti is also a destination country for migrants. The country is home to several thousand young people, including women and children, who work in several sectors and represent an essential component of the informal sector.
Migration dynamics towards Djibouti are mainly linked to the situations prevailing in neighboring countries; notably insecurity, persecution, violence, conflicts, poverty, climate change and environmental degradation and political and economic instability lead to the influx of migrants from neighboring countries to Djibouti. Migrants travel in groups, most of the time on foot, to cross Djibouti territory. They are often subject to violations of their human rights during their migratory journey.
The Djiboutian government has ratified several international instruments for the protection of Human Rights adopted within the United Nations, notably the Additional Protocol to the United Nations Convention against Transnational Organized Crime (Palermo Convention) of November 15, 2000 aimed at preventing, repress and punish trafficking in persons, particularly women and children ratified by the Republic of Djibouti in April 2005. IOM supports the government’s efforts in the popularization of these international legal instruments.

On December 27, 2022, the government of the Republic of Djibouti adopted a Decree establishing the missions, composition, organization and operation of the National Vigilance Body in the fight against trafficking in persons and similar practices. been adopted. It is placed under the authority of the Minister of Justice and its mission is to prevent and combat human trafficking, to protect the fundamental rights of victims of trafficking, to design a comprehensive framework for prevention, protection and assistance. to victims and witnesses, investigations, prosecutions and repression of trafficking in persons in all its forms with a view to achieving effective and appropriate sanctions linked or not to organized crime, and finally to promote regional cooperation and international. This national vigilance body is made up of representatives of different public institutions. It is planned to represent this body in the 5 regions by units combating human trafficking and similar practices.
In order to continue this work of popularizing international and national texts, the IOM plans to work with the national school of judicial studies to explain to listeners who are training within this school the Additional Protocol to the United Nations Convention against transnational organized crime (Palermo Convention). This is an educational work which will allow listeners to strengthen their knowledge of the national and international texts to which the Republic of Djibouti is a party. To do this, IOM is seeking to recruit a national consultant to prepare training modules on the national and international legal framework for combating human trafficking and similar practices. The successful candidate will also lead a training session including practical cases for student magistrates from the National School of Judicial Studies.

II- Main objective of the consultancy

Prepare training modules on the national and international legal framework for combating human trafficking in the Republic of Djibouti and lead a two (02) day training course for the benefit of ENEJ student lawyers .
III- Specific objectives

Develop training tools on the national and international legal framework for combating human trafficking;

Have a good knowledge of the problem of trafficking and smuggling,

Be familiar with the national and international legal frameworks for the protection of human rights,

Explain the existing national and international legal framework to combat human trafficking to students of the ENEJ

Help student magistrates to better understand the legal arsenal for combating
human trafficking in the Republic of Djibouti
IV – Expected results

Training tools on the national and international legal framework for combating human trafficking are developed

The existing national and international legal framework for combating human trafficking is explained to ENEJ students

Student magistrates better understand the legal arsenal for combating human trafficking in the Republic of Djibouti

Students are able to apply these laws in the context of their work.
V- Deliverables

A presentation in the form of a power point validated by the IOM and the ENEJ

A final training report which will take into account the national and international legal framework part and the part of the pre and post test report.

VI- Methodology
The training will be based on a participatory and dynamic approach. Plenary presentations followed by discussions will allow participants to better understand the issue of the national and international legal framework for human trafficking in Djibouti. Learners will ask questions and also speak about their experience. But also, learners will be required to take tests at the start of the training and at the end of the training.

VII- Period
The training as a whole will last 3 days, the part devoted to the national and international legal framework will take two days. The consultant must prepare and submit to participants practical cases of application of legal texts to stimulate debate and allow participants to better understand the provisions of the law.
The successful candidate will have a period of three days of preparation which will be part of the consultancy period.
VIII- Education
Master’s degree or doctorate in public or private law / Political science or International Relations
IX- Experiences

Experience in higher education,

Work experience in law firms, notaries or legal advisors,

Work experience with the United Nations System would be an asset

Experience working in legal services
