DESCRIPTION OF THE ASSOCIATION
La Chaîne de l’Espoir is an international NGO founded in 1994. Its mission is to strengthen health systems to give everyone, and in particular children, the same chances of survival and development.
We operate in 28 countries with a global approach, focused on the child but also on mothers and disadvantaged communities:
- Prevention and screening from an early age, particularly within the framework of school health programs.
- Care and surgery, to meet the most urgent needs of children and their mothers.
- Training and skills transfer to local teams thanks to our international network of experts in all areas of surgery.
- Construction and equipment of hospital structures adapted to local needs.
POSITION AND MISSION
The holder of the position guides and organizes activities in order to guarantee the legal security of the association.
He advises teams at headquarters and in the field in the implementation of legal and regulatory obligations and participates in contract negotiations when necessary. He ensures compliance with commitments made and plays an alert role with Management.
He participates in risk management by raising teams’ awareness of the content of legal frameworks, training them in tools and best practices.
He contributes to the defense of the interests of the association and its representatives.
MAIN ACTIVITIES
Legal framework :
- Appreciates the applicable legal framework and the obligations of the association (excluding social law)
- Identifies and analyzes legal, financial and administrative risks arising from the practices of teams at headquarters in the field
- Alerts team leaders and management to the legal risks incurred and makes recommendations
- Coordinates the consultation of lawyers on different fields of expertise
- Supports procedures for registration or renewal of agreements with local authorities
- Advises operational staff or head office services on tax matters in collaboration with Accounting
- Carry out legal and regulatory monitoring
Contract law :
- Supervises the management of contracts, offers tools to operational staff to facilitate and secure their drafting (models, checklists, etc.)
- Participates in the negotiation of commitments with third parties
- Supports the monitoring of the execution of commitments in the event of difficulties
- Supports the management of disputes and advises Management on the measures to be taken
- Participates in the management of insurance contracts
- Proposes the methods for creating a documentary base for the archiving of contracts
Legal Secretariat :
- Ensures the regularity of meetings of statutory bodies
- Produces and records all documentation (summons, powers of attorney, minutes, registers, etc.) and legal declarations to the authorities in France
- Maintains delegations of authority
- Carry out and monitor the filing of trademarks and patents on behalf of the Association at the request of the Development Department or the General Management
Transverse :
- Ensures training and awareness of legal subjects for employees in the field
- Participates in the structuring of the association through the formalization of procedures and tools
- Carry out specific legal studies at the request of Management
- Builds the budget of his department with an eye to efficiency and costs, and guarantees the monitoring and control of expenses within his scope with the tools and support of Management Control
- Participates in the selection and supervision of the execution of contracts of legal service providers
- Participates in project proposals and partner due diligences
- Leads the network of volunteer lawyers and service providers in collaboration with the DAF
FORMATION ET EXPERIENCES
- Master 2 in private law (contract law, tax law, litigation, international law)
- 5 years of experience including at least 2 years of legal practice
REQUIRED SKILLS AND QUALITIES
- Very good capacity for analysis and synthesis,
- Comfortable with research and interpretation of legal texts, regulations and case law;
- Rigor, interpersonal skills, writing skills;
- Ability to organize and manage priorities;
- Respect for confidentiality;
- Ability to work in multidisciplinary and multicultural teams,
- Flexibility of mind and sense of service;
- Knowledge of the international solidarity sector essential
CONDITIONS
- Permanent contract
- Start date: ASAP
- Full-time position, based at the association’s headquarters in Paris 15th or relocated
- Mutual insurance covered at 80%
- Transport subscription (or Sustainable Mobility package) covered at 50%
- Meal ticket with a face value of €10.83 covered at 60%
- Teleworking charter: 03 days/week OR 100% teleworking with 4 days/month of mandatory presence at headquarters
- 23 days of annual RTT
- Proposed Salary: Depending on profile and experience
