TERMS OF REFERENCE

CONSULTATION CONTRACTOR / FOR THE REALIZATION OF ACTIVITIES AND SPECIALIZED TOOLS OF ASSISTANCE TO STRENGTHEN THE INVESTIGATION AND JUDICIALIZATION OF SOME MANIFESTATIONS OF ORGANIZED CRIME

one.BACKGROUND

The Pan American Foundation for Development in Panama (PADF) within the framework of the PROJECT OF STRENGTHENING OF CAPACITIES OF THE JUDICIAL SECTOR TO COMBAT THE TRANSNATIONAL DELICUENCE, FINANCIAL CRIMES AND
CORRUPTION IN PANAMA (CTOC +) seeks the hiring of a natural person to prepare an interpretation guide for the criminal type of money laundering described in the Panamanian Penal Code and to carry out face-to-face training about its content.

2. OBJECTIVE OF THE CONTRACTING

Develop technical guidelines that allow guiding the officials who are part of the Attorney General of Panama on the interpretation of the elements that make up the criminal type of money laundering.

Specific objectives

  • Prepare a specialized guide for interpreting the criminal type of money laundering in Panamanian law.
  • Carry out two trainings on the subject matter of the consultancy.

3. RESPONSIBILITIES OF THE CONSULTOR

  • Prepare a technical document in the form of a specialized interpretation guide on the crime of money laundering, its scope, its source crimes and its guiding verbs, in light of Panamanian legislation and that includes at least the following content:
    • Analysis of the structure of the criminal type of money laundering in Panamanian legislation.
    • Interpretation of the criminal type of money laundering, determination of its scope and identification of its application in the various stages or phases.
    • Analysis of the crimes resulting from money laundering in Panamanian legislation, its guiding verbs, its scope against the stages or phases of money laundering.
    • Identification of vulnerabilities, eventual antinomies, regulatory gaps and indication of good practices.
    • Recommendations to improve the system.
  • Write, correct texts and style, and generate a document edited in pdf format.
  • Coordinate with the PADF team and attend the work meetings that are called to fulfill the object of the contract.
  • Training on scope and content of the guide.

4. REQUIRED PROFILE

  • Professional in law, with postgraduate studies in criminal law.
  • Minimum experience of 8 years in charges related to the investigation or prosecution of criminal conduct, especially related to forms of organized crime.
  • Desirable experience as a university professor of criminal law, criminal procedural law, criminology or in training programs in related subjects (LA / FT risk management, compliance, among others).
  • Desirable to have proven experience as a trainer / instructor of law enforcement, intelligence or investigation and prosecution agency training programs.

5. CONTRACTING DEAD

The contract will have a maximum duration of 120 days.

6. PAYMENT FORM

Deliverable 1

  • Deliverable Detail: Technical working proposal that must contain:
    • Projection of the guide, with the methodological description for its construction.
    • Projection of the work tables and on-site visits necessary for the construction of the guide.
  • Delivery date: 5 days from the signing of the contract
  • Value: 30%

Deliverable 2

  • Deliverable Detail: Delivery and presentation of the guide
    • Guide to the hermeneutical interpretation of the crime of money laundering and its source crimes.
  • Deliverable Detail: Delivery of the training projection to be carried out according to the guide
    • Methodological description of how to carry out the training.
    • Evaluation design of input and output evaluation form.
  • Delivery date: Between 45 and 90 days from the signing of the contract
  • Value: 40%

Deliverable 3

  • Deliverable Detail: Carrying out the training according to the requested guide and the
    training proposal approved by CTOC +
  • Delivery date: Between 90 and 120 days from the signing of the contract
  • Value: 30%

7. TERM FOR THE RECEPTION OF PROPOSALS

This call will be open from June 11 to June 25, 2024. The applicant must submit an economic proposal, as well as a technical proposal to build the guide and the proposed training.

Please note that the consul will work remotely, but you may need to travel to Panama for three technical visits. The cost of the trip can be included in the economic proposal.

Amendments: At any time before the deadline for submitting proposals, PADF may, for any reason, modify the Terms of Reference document by means of an amendment that will be published on the PADF website and / or communicated by email.

8. INTELLECTUAL PROPERTY

The professional is prohibited from any type of publication, disclosure or marketing of the products subject to this contract as it will be understood that it will become the property of PADF-CTOC + in the same way, the disclosure of confidential information that arrives is prohibited to your knowledge as part of the execution of your activities.

9. ABOUT PADF

10. TERMS AND CONDITIONS

Resulting Award
This TOR does not obligate PADF to execute a contract, nor does it commit PADF to pay any costs incurred in the preparation or submission of the proposals. Furthermore, PADF reserves the right to reject any and all offers, if such action is considered to be in the best interest of PADF. PADF will, in its sole discretion, select the winning proposal and is not obliged to share individual evaluation results.

Confidentiality
All proprietary information provided by the bidder shall be treated as confidential and will not be shared with potential or actual applicants during the request process. This includes but is not limited to price quotations, cost proposals and technical proposals. PADF’s evaluation results are confidential.
