CONTEXT AND JUSTIFICATION

Established in 1951, IOM is the leading intergovernmental organization in the field of migration and works closely with governmental, intergovernmental and non-governmental partners. IOM works to promote humane and orderly migration for the benefit of all. It does so by providing services and advice to Governments and migrants in the country.

Border management agencies in West Africa face some challenges related to border management, including the lack of adequate infrastructure and equipment at existing border posts, the porosity of borders, the activities of trafficking and smuggling networks. L’increase in the movement of people, associated with the emerging threat of violent extremism spreading from the Sahel and current health emergencies of international concern, is, raising concerns about the long-term security of borders and regional stability in West Africa, therefore require’ to adapt the governance responses of’immigration and borders so that’elles can better manage the flow of people.

It is within this framework that’OIM supports the Ivorian Government to strengthen efforts to prevent conflicts and promote peace, then to promote a balance between facilitating the mobility of people and goods and the imperatives of controlling cross-border movements. The programmes and activities of the’OIM combine access to basic social services, peacebuilding and migration management, investing in conflict prevention and management.

In april 2024, the Ministry of the’Interior and Security (MIS) of the Cote d’Ivoire has requested the’OIM support for the installation of the’Information and’Analysis System of Migratory Data (MIDAS) at the terrestrial’ entry points with a view to considerably strengthening the system for controlling and monitoring cross-border movements and ensuring optimum security of the border area.

To strengthen the control of regular migration flows and facilitate trade and development, the’Information and’ Migratory Data Analysis System (MIDAS), designed by’OIM, is, and which guarantees that the User Governments have full and exclusive ownership of all biometric data registered at the level of the borders, will be deployed in Cote d’Ivoire.

Although the digitization of information and data is an effective tool, it can also pose a threat and open doors to abuse or the’use of data outside the system. Therefore, it is essential that directors, supervisors and loggers responsible for personal data processing systems are able to protect this information in accordance with law n° 2013-450 of 19 June 2013, protecting personal data in Cote d’’Ivoire, but also in Ordinance n°2012-293 of 21 March 2012, creating the’Authorite de Regulation des Telecommunications/ICT de Cote d’Ivoire (ARTCI).

To carry out the deployment process of this system,’OIM recruits a Consultant(e) Jurist.

JOB DESCRIPTION

Under the general supervision of the Head of Mission and the direct supervision of the IBG Programme Manager and the MIDAS Regional’Expert, the incumbent of the post will analyse the legal framework, institutional and operational Ivorian in terms of possession,’ use, sharing and protection of personal data to determine whether the minimum standards for the implementation of MIDAS are met or whether additional political or operational measures are necessary before its deployment, and to define the possible needs and deviations with respect to national, regional and international standards, to’ identify and define the possible gaps and the needs of reinforcement or’harmonization, and, then make recommendations based on findings.

  • Tasks related to deliverables

The/The Consultant (e) Lawyer will be responsible(e) to ASSUME the following tasks :

  • L’analysis of the actors and structures involved in the processing of personal data in Cote d’Ivoire, such as registration, conservation,’use, sharing, etc, l’archiving and destruction of data and the level of security of’access to this data ;
  • The identification of the practical arrangements made by those responsible for the processing of personal data for the security of their data and the examination of their compliance with existing texts ;
  • An inventory and review of all existing legal instruments governing the life cycle (creation, processing, storage, sharing/transfer, destruction) of data in Cote d’Ivoire, France, including the legislation in force on the protection of personal data ;
  • A review of strategic priorities and institutional arrangements established for strengthening data protection in Cote d’’Ivoire and needs ;
  • An in-depth analysis of compliance with the applicable subregional, regional and international data protection instruments and their level of’integration into the applicable legal framework in Cote d’Ivoire ;
  • A review of all technical and financial partners involved in the field of data protection and their strategies, with reference to the implementation of national legislation on the protection of data ;
  • L’ identification of the shortcomings and inconsistencies of the legal and institutional arrangements in Cote d’Ivoire and proposal of recommendations to remedy them ;
  • The proposal for coherent and realistic recommendations to the problems identified ;
  • The proposal of’a plan of’actions for the implementation of the recommendations ;
  • L’execution of any other task requested in the’ interest of the project.
  • Deliverables and work plan

Week 1 – Work from home office (research)

  • Report of’a detailed work plan and’a methodology ;
  • Synthetic report of data collected ;
  • Proposal of’a maintenance grid or’information sheet to be collected on site.

Week 2 to 3 – Fieldwork

  • Meetings with interlocutors in the country ;
  • Proposal of the’global architecture of the’s report Situation analysis (table of contents) for the validation of the’ and the national authorities involved ;
  • Draft of the’ situation analysis report for the contributions of’OIM and the national authorities concerned.

Week 4 – Home office work (compilation/editing)

  • Realization of’a PowerPoint presentation of the’analysis of the situation (methodology, main conclusions, identified shortcomings, recommendations) to be provided to the Ivorian authorities for contribution and validation ;
  • Final report of’analysis of the situation incorporating all the comments and the suggested modifications.
  1. Performance indicators for’assessment of results
  • Quality Compliance with the consultation deadline ;
  • Quality of services rendered.

PROFILE

Education

  • Master’s/Master’s degree in Public International Law, Political or Social Sciences, International Studies or a related legal field of an accredited’ educational institution[1] with five (5) years of’ relevant professional experience in similar missions in Cote d’Ivoire ;
  • University degree in the above fields with seven (7) years of’ relevant professional experience.

Experiences

  • Experience in evaluating and writing’studies reports is required ;
  • Experience in liaising with government authorities, other national and international institutions and donors, and’ with civil society organisations; and;
  • Previous experience of’a similar situational analysis of the protection and management of personal data at national or international level would be an advantage ;
  • Experience in the collection and’ analysis of secondary data and the conduct of semi-structured interviews is mandatory.

Skills

  • Having a basic knowledge of MIDAS or similar software would be an asset to the project ;
  • Knowledge of international laws and standards in the field of’ identification and protection of personal data is mandatory ;
  • Have a mastery of national legislation, standards and procedures in the field of personal data protection ;
  • Excellent communication skills, both orally and in writing, and accepts constructive criticism ;
  • Ability to work under pressure and effectively with local authorities, beneficiaries and the wider community to advance project objectives and then meet tight deadlines ;
  • Demonstrated ability to’ establish and maintain strong working relationships with relevant government partners, UN organizations, civil society organizations/NGOs and private sector entities as well as’ with other’execution partners.
  • Knowledge of common computer tools (MS Office, etc.) and relevant technology solutions.
